Liability Disclaimer:
1. TripMozy Private Limited (“Company”) acts solely as an intermediary platform between customers and independent third-party service providers, including but not limited to travel agents, tour operators, hotels, resorts, transportation providers, and property owners (“Partners”).
2. The Company shall not be held liable for:
Any deficiency in services, acts, omissions, delays, cancellations, overbooking, or changes made by the Partner.
Any injury, loss, damage, accident, sickness, theft, natural calamity, political disturbance, or any other unforeseen circumstance occurring during the course of travel or stay.
Errors or inaccuracies in information provided by Partners, including pricing, availability, or descriptions.
3. The Company’s liability shall, in any case, be limited only to the commission earned on the booking in question and shall not extend to the full booking amount.
4. Customers and Partners acknowledge and agree that all bookings are made at their own risk, and TripMozy shall not provide any warranties, express or implied, except as expressly mentioned in written agreements.
Dispute Resolution:
1. The Parties agree to make all reasonable efforts to resolve disputes amicably through negotiation and mutual discussion within 30 (thirty) days of the dispute being notified in writing.
2. In the event the dispute cannot be resolved amicably, it shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended.
* The arbitration proceedings shall be conducted by a sole arbitrator mutually appointed by the Parties.
* The venue and seat of arbitration shall be District Court, Malda, West Bengal.
* The language of arbitration shall be Bengali orEnglish.
3. The award of the arbitrator shall be final and binding on both Parties.
4. Subject to the above arbitration clause, the courts at District Court, Malda, West Bengal shall have exclusive jurisdiction** in all matters arising out of or in connection with this Agreement.
